Terms of Service

Please read these Terms of Service ("Terms") carefully before using the FaceHush mobile application ("the App"). By downloading or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Licence Grant

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to use FaceHush on any iOS device that you own or control, solely for your personal, non-commercial purposes. This licence does not permit you to redistribute the App or sublicense any of its contents.

2. Subscription and Billing

FaceHush offers an optional Pro subscription that unlocks additional features. Subscriptions are offered on a monthly ($4.99/month) or annual ($29.99/year) basis and are processed entirely through the Apple App Store.

• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.
• Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period.
• You can manage and cancel your subscription at any time through your iPhone Settings → Apple ID → Subscriptions.
• No refunds are provided for unused portions of a subscription period, except as required by applicable law.
• Prices are in US dollars and may vary by country due to Apple's local pricing.

The free tier remains available with limited features regardless of subscription status.

3. Your Content

FaceHush processes photos that you choose to import from your device's photo library. You retain full ownership of your photos and any exported results. We claim no ownership over your content.

All image processing occurs entirely on your device. Processed images and face data are never transmitted to our servers.

4. Acceptable Use

You agree not to use FaceHush to:

• Violate any applicable laws or regulations.
• Infringe the privacy or rights of others — you are responsible for obtaining appropriate consent before censoring and sharing photos of other people.
• Attempt to reverse-engineer, decompile, or extract source code from the App.
• Use the App to create, distribute, or promote illegal, harmful, or deceptive content.
• Circumvent in-app purchase mechanisms or attempt to unlock Pro features without payment.

5. Intellectual Property

The App, including its design, code, graphics, and all other content (excluding your photos), is owned by the developer and protected by copyright and other intellectual property laws. The "FaceHush" name and logo are proprietary. Nothing in these Terms grants you any right to use our trademarks or branding.

6. Privacy

Your use of FaceHush is also governed by our Privacy Policy, which is incorporated by reference into these Terms.

7. Third-Party Services

The free version of FaceHush includes advertising served by Google AdMob. Your use of the App is also subject to Google's terms of service and privacy policy. Subscriptions are processed by Apple; use of the App Store is subject to Apple's Terms and Conditions.

8. Disclaimer of Warranties

FaceHush is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components.

Face detection accuracy depends on photo quality, lighting, and face angle. We make no guarantee that all faces in a given photo will be detected or correctly identified.

9. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall the developer be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or damage to goodwill, arising out of or related to your use of the App, even if advised of the possibility of such damages.

Our total liability to you for any claims arising from these Terms or your use of the App shall not exceed the amount you paid for the App or subscription in the 12 months preceding the claim.

10. Termination

We reserve the right to modify or discontinue the App at any time. These Terms remain in effect until terminated. Your rights under these Terms will terminate automatically if you fail to comply with any of their provisions.

11. Changes to These Terms

We may revise these Terms from time to time. We will notify you of significant changes by updating the "Last updated" date. Your continued use of the App after changes are posted constitutes acceptance of the revised Terms.

12. Governing Law

These Terms are governed by and construed in accordance with applicable law. Any disputes arising under these Terms shall be resolved through good-faith negotiation or, where necessary, through binding arbitration or the courts of competent jurisdiction.
